The Effectiveness of Online Mediation in Divorce Cases: Opportunities and Challenges in Realizing the Principle of Simple Judicial Proceedings

The digitalization of the judicial system through the e-Court policy has brought about significant changes in the management of civil disputes in Indonesia, including the implementation of electronic (online) mediation. Under Supreme Court Regulation (PERMA) Number 3 of 2022, online mediation is envisioned as a solution to realize the principles of simple, fast, and low-cost judicial proceedings, particularly in divorce cases characterized by high emotional intensity. This study aims to analyze the effectiveness of online mediation in achieving settlements and to identify the technical and psychological obstacles that arise during the process. Employing a normative juridical research method primarily drawing on legal journals. The findings indicate that while online mediation offers time and cost efficiencies, its success relies heavily on the parties' technological literacy and the mediator's proficiency in managing virtual communication. Key challenges include the loss of the human emotional touch and technical network issues that frequently impede the negotiation process.
